Below is an account of a
vehicle accident involving a bus with somewhat unusual characteristics
In 2007, Overlawyered.com posted (link below) on the bus accident that
resulted in a $2.8 million judgment
against the bus company.
Vehicle 1 was traveling on an Interstate highway and
was struck from behind by Vehicle 2. Vehicle 1
traveled across the median and into the path of the bus
which was traveling in the opposite direction.
The lawyer for Vehicle 1's occupants produced an expert witness who testified of deficiencies in the bus
company's brake maintenance and driver training programs.
Despite the fact the bus didn't cause the accident,
the bus company ended up with a judgment of just
under $3 million.
This is a good example of why a good company safety
and loss control program should extend beyond simple
OSHA compliance. As a safety consultant, you might
want to save this article to explain this importance
to current and future clients. It could result in
the client asking you for additional safety consulting
and training services.
It would also be a strong example to use in any driver
training and/or vehicle maintenance training activities
you provide to clients.
